2. SUBJECT MATTER AND DEFINITIONS OF THE PRELIMINARY INFORMATION FORM

a. This Preliminary Information Form (the “form”) has been prepared in order to inform the buyer, prior to the conclusion of the relevant distance sales and/or service contract, about the item (s) and/or service(s) offered by the seller, their essential characteristics, the identity and contact details of the Seller, and other information required under the mandatory consumer protection laws applicable to the relevant transaction.

b. The subject matter of this form is the potential purchase and/or order of goods and/or services offered through the seller’s electronic commerce website (https://www.personaluniques.com) and through the official social media channels associated with the brand, in relation to:(i) one or more luxury fashion items, including where applicable brand new, second-hand, pre-owned, vintage, restored, or otherwise previously used goods (the item(s)”); and/or(ii) related luxury fashion sourcing, procurement assistance, reservation, concierge, authentication support, or similar ancillary services, where expressly offered on the website and/or official social media channels (the “Service(s)”).

c. The specific legal entity acting as the seller in the relevant transaction, together with its identification and contact details, shall be the entity expressly identified in section 1 and/or otherwise clearly indicated to the buyer during the ordering process and in the order confirmation. Where the seller operates through different affiliated entities in different jurisdictions, the contracting seller may vary depending on the nature of the transaction, the buyer’s location, the location of the relevant item or service, applicable legal or tax requirements, and the seller’s internal operational structure.

d. As stated on the website and through the seller’s official social media channels, the item(s) offered by the seller may include brand new, second-hand, pre-owned, vintage, archival, restored, or otherwise previously used luxury goods. Accordingly, such item(s) may display signs of prior use, aging, storage wear, repairs, alterations, replacement parts, packaging differences, missing accessories, or other condition characteristics consistent with their nature and age. The seller shall use reasonable care to provide accurate and fair disclosures regarding the authenticity, condition, and essential characteristics of the relevant item(s), subject always to normal and reasonably expected variation for pre-owned luxury goods.

e. This form shall apply exclusively to transactions in which the buyer acts as a consumer within the meaning of the mandatory laws applicable to the relevant transaction. Where the buyer acts for commercial, professional, resale, or business purposes, this form shall not apply, and the relevant commercial terms and general legal provisions shall govern the relationship between the parties.

f. Nothing in this form shall be interpreted as limiting, excluding, or waiving any mandatory consumer rights available to the buyer under the laws mandatorily applicable to the relevant transaction.

3. ITEM(S) SUBJECT TO THE CONTRACT

Unless otherwise expressly stated, the estimated delivery period applicable to the relevant item(s) and/or service(s) shall be the delivery period communicated to the buyer during the ordering process, through direct communication, and/or in the order confirmation. No fixed universal delivery period applies to all orders, and delivery times may vary depending on the nature of the item(s), sourcing conditions, stock availability, operational processes, logistics, and any other circumstances affecting fulfillment.

4. FINAL SALE POLICY

a. Finality of Orders: Due to the nature of the seller’s business model, including sourcing, reservation, procurement, and allocation of luxury item(s), orders are generally treated as final once confirmed by the seller and shall not be cancelled, returned, exchanged, modified, or refunded.

b. No Cancellation / No Return / No Exchange

The buyer acknowledges and agrees that all purchases made from the seller are made on a strict final sale basis. Accordingly, once an order has been placed and confirmed:

  • the order may not be cancelled;
  • the item(s) may not be returned;
  • the item(s) may not be exchanged;
  • the order may not be modified, replaced, or converted into another item, service, credit, or alternative transaction form.

This rule shall apply regardless of whether the item(s) are brand new, second-hand, pre-owned, vintage, archival, collectible, restored, sourced, reserved, consigned, or otherwise specially obtained or prepared.

c. Services and Procurement-Based Transactions: Where the order includes any sourcing, reservation, procurement assistance, concierge, authentication support, item-finding, or similar ancillary service(s), the buyer expressly acknowledges that such services may begin immediately upon or shortly after order confirmation. Accordingly, such service-related transactions shall also be treated as final and non-cancellable, non-refundable, and non-exchangeable.

d. Buyer Responsibility Before Purchase: The buyer is exclusively and solely responsible for carefully reviewing all item and/or service information made available prior to purchase, including but not limited to the item’s brand, model, category, measurements, dimensions, materials, condition, signs of use, accessories, packaging, visual disclosures, and any other relevant characteristics. The buyer acknowledges that no cancellation, return, refund, or exchange request shall be accepted on the grounds of personal preference, change of mind, size expectation, fit expectation, styling expectation, delivery expectation, resale expectation, investment expectation, or similar subjective reasons after the order has been confirmed.

5. ITEM NON-CONFORMITY, INCORRECT ITEM, AND AUTHENTICITY

a. Incorrect Item / Non-Conforming Item: In the seller’s reasonable discretion, if it is determined that the item delivered to the buyer is materially different from the item ordered or materially inconsistent with the item description provided during the ordering process, the seller may, taking into account stock availability, procurement feasibility, operational conditions, and the nature of the item, elect one of the following remedies:

  • accept the return of the relevant item and deliver the correct item in replacement;
  • refund the full amount of the payment; and/or
  • apply the relevant amount as customer balance, account credit, or open shopping credit for use by the buyer in a future purchase.

b. Seller Discretion Regarding Commercial Resolution: The buyer acknowledges and agrees that, in cases of incorrect item dispatch, item mismatch, or other non-conformity attributable to the seller, the commercial resolution method may be determined by the seller in accordance with the principle of good faith, taking into account the uniqueness, sourcing complexity, availability, condition, collectability, pricing, and replacement feasibility of the relevant item.

Where deemed appropriate, the seller may offer the buyer one or more of the following commercial resolution options:

  • return and replacement;
  • return and store/account balance;
  • return and sourcing of the correct item;
  • Return of the item and refund of the item price to the customer, where deemed appropriate by the seller.

c. Authenticity-Related Claims: If, following the seller’s internal review and/or any authenticity verification process deemed appropriate by the seller, an item is determined by the seller to be non-authentic, materially misrepresented in terms of authenticity, or otherwise not compliant with the authenticity representation expressly provided during the ordering process, the Seller shall resolve the matter by electing one of the following remedies:

  • a full refund of the purchase amount paid by the buyer; or
  • procurement and delivery of the same item, or where deemed appropriate a substantially equivalent authentic replacement item, subject to availability and sourcing feasibility.

d. Return and Review Process: In any case involving an incorrect item, item mismatch, or authenticity-related review, the buyer shall cooperate in accordance with the principle of good faith with the seller’s review, verification, and return process, including where reasonably required the provision of photographs, packaging details, order information, serial information, and return of the item in the condition in which it was delivered, save for reasonable inspection.

6. DISPUTE RESOLUTION

a. Buyers Qualifying as Consumers: In cases where the buyer qualifies as a consumer, any disputes arising from this preliminary information form and/or the sales transaction shall be governed by the applicable mandatory consumer protection laws of the relevant jurisdiction.

For transactions carried out within the borders of the Republic of Türkiye, the buyer may submit complaints and objections to the competent consumer arbitration committee and/or consumer courts in accordance with the applicable legislation.

For transactions connected to Dubai / United Arab Emirates, disputes shall be resolved before the competent consumer protection authorities and/or competent courts in accordance with the applicable laws and regulations of the relevant jurisdiction.

b. Buyers Not Qualifying as Consumers: In cases where the buyer does not qualify as a consumer, any disputes arising from this preliminary information form and/or the sales transaction shall be subject to the following jurisdictions:

  • For transactions connected to Türkiye, the Istanbul (Central) Courts and Istanbul enforcement offices shall have jurisdiction;
  • For transactions connected to Dubai / United Arab Emirates, the competent courts and enforcement authorities of Dubai shall have jurisdiction.

7. COMPLAINTS AND OBJECTIONS

a. The buyer may communicate any requests, complaints, objections, or claims relating to the item(s), the services offered by the seller, or the sales process through the following channels:

The buyer may submit item- and sale-related requests and complaints either verbally or in writing through the communication channels indicated above. The seller shall make reasonable efforts to review and address all legitimate requests and complaints submitted by the buyer.

In the event that no mutually satisfactory resolution can be reached, the buyer may:

  • submit an application to the consumer arbitration committees located either at the buyer’s place of residence or at the seller’s place of business; or
  • where the dispute amount exceeds the applicable statutory monetary thresholds, initiate proceedings before the competent consumer courts.

b. The buyer hereby declares, acknowledges, and accepts that, prior to the completion of the order, he/she/it has read, understood, and electronically approved this Form, all terms and conditions available on the website, and the applicable distance selling agreement, and accepts that all such terms, obligations, conditions, disclosures, and contractual provisions shall be binding upon the parties.
